Anliveda Yoga Organics Private Limited (“Anliveda”) provides a personalized enrolment service that allows our enroled yoga practitioners to access yoga tutorials/videos (“Anliveda content”) streamed and strictly not downloadable over the Internet to computers, mobile phones/smartphones through respective application, certain internet-connected TVs and likewise devices with internet connection.

These Terms of Use govern your use of our service. As used in these Terms of Use, “Anliveda service”, “our service” or “the service” means the service provided by Anliveda for discovering and watching content on the Anliveda Yoga web-site/s, including all features and functionalities, recommendations and reviews, the website, and user interfaces, as well as all content and software associated with our service.

Anliveda Services & Products
1. There are two types of accounts/profiles which you can open:
  1. The accounts for Yoga Practitioners / Yoga students world-wide, for which everybody is eligible as prescribed in the agreement, who like to enjoy yoga tutorials/courses/sessions provided on-line by yoga experts around the globe. The account is free, the selected courses are available upon payment of a fee per each tutorial/course/session for the duration as specified in Section 2 – Enrolment.
  2. The accounts for Certified Yoga Teachers for which certified Yoga Teachers around the world qualify. They are eligible, upon presentation of their valid yoga teacher certificates (uploaded for Anliveda Yoga Admin to review), to have a Yoga Teacher account with teacher profile section. These Yoga Teachers are further eligible to provide their yoga or meditation tutorials/courses/sessions in video format to ANLIVEDA YOGA ORGANICS PVT. LTD. for uploading them on the Anliveda Yoga web-site/s in accordance with the Terms of Reference specified for participating in the ANLIVEDA YOGA web-site. Certified Yoga Teachers can open a Teacher’s account and can enjoy, upon presentation of their valid yoga teacher certificates, eligibility to join the Anliveda Yoga internet platform/s as provided through the Anliveda web-site/s, can have their own yoga tutorials uploaded and participate as set forth in the separate agreement for participating certified Yoga Teachers. The Teacher account/profile includes the possibility to offer own yoga courses under own prices via the Anliveda Yoga web-site and to upload up to ten course (each maximum length of 30 minutes duration). The respective Yoga Teacher is responsible for keeping the profile and course information updated and for complying with the regulations as set forth by the Terms of Use and the related laws. For provding space in the Anliveda Yoga online forum of yoga educational material, courses and information, and, for the related administrative services, Anliveda Yoga Organics Pvt. Ltd. will charge the participating Yoga Teacher a fee of 60.00 Euro respectively 70.00 US$ for a six months tenure, or, 100.00 Euro respectively 120.00US$ for an annual renting of the space on the Anliveda Yoga internet site. The teachers manage their course materials, course prices, offers and customer communication in their own responsibility in compliance with relevant country and international laws and ethic standards.
2. Accepted Yoga Teachers are eligible to upload their own yoga educational courses on the Anliveda web-site as specified under the provisions as laid out for Teacher account in separate document. The teachers with their self-produced videos, after acceptance by Anliveda Yoga shall present their self-produced videos, which after quality check and approval shall be uploaded to the site through the IT team and teachers will be guided through the administrative procedure for collecting revenues on their self-produced video courses. 3. You must be 14 years of age to become eligible for enrolment of yoga courses and to use the Anliveda services. If you are below 14 years of age (minors), then you may only use the service under the supervision of an adult.
4. The Anliveda services and any content viewed through the services are for your personal and non- commercial use only and may not be shared with other individuals. During your Anliveda enrolment period, Anliveda Yoga Organics Pvt. Ltd. grants you a limited, non-exclusive, non-transferable right to access the Anliveda services and view content on the Anliveda Yoga web- site/s. Except for the foregoing, no right, title or interest shall be transferred to you. You agree not to use the services for public performances.
5. The Anliveda services, including the Asana Library (content library), is regularly updated. In addition, we continually test various aspects of our service, including our website, user interfaces, promotional features and availability of Anliveda content.
6. You agree to use the Anliveda services, including all features and functionalities associated therewith, in accordance with all applicable laws, rules and regulations, or other restrictions on use of the service or content therein. You agree not to archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use (except as explicitly authorized in these Terms of Use) content and information contained on or obtained from or through the Anliveda services. You also agree not to: circumvent, remove, alter, deactivate, degrade or thwart any of the content protections in the Aliveda service; use any robot, spider, scraper or other automated means to access the Anliveda services; decompile, reverse engineer or disassemble any software or other products or processes accessible through the Aniveda services; insert any code or product or manipulate the content of the Anliveda services in any way; or use any data mining, data gathering or extraction method. In addition, you agree not to upload, post, e-mail or otherwise send or transmit any material designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the Anliveda services, including any software viruses or any other computer code, files or programs. Anliveda reserves the right to terminate or restrict your use of our service or introduce you to judiciary if you violate these Terms of Use or are engaged in illegal or fraudulent use of the services.
7. The quality of the display of the Anliveda content may vary from device to device, and may be affected by a variety of factors, such as your location, the bandwidth available through and/or speed of your Internet connection. HD, Ultra HD and HDR availability is subject to your Internet service and device capabilities. You are responsible for all Internet access charges. Please check with your Internet provider for information on possible Internet data usage charges.
8. Anliveda software is developed by, or for, Anliveda and is designed to enable viewing of Anliveda content. This software may vary by device and medium, and functionalities and features may also differ between devices. You acknowledge that the use of the services may require third party software that is subject to third party licenses governed by their respective terms and conditions. You agree that you may automatically receive updated versions of the Anliveda and related third- party software.
9. In addition to the digital educational yoga course materials and other digital products, Anliveda Yoga Organics Pvt. Ltd. offers incense sticks, cones and other incense and aromatic oil and parfumery products, as well as yoga equipment items, yoga and fashion wear products, and, home décor and wellness items. These are presented on this web-site for purposes of show case. These products are subject to whole sale business aiming at distributors, whole sales business persons, suppliers etc.

Enrolement
1. Enrolment Cycle: Your enrolment fee is charged per each of the various Anliveda Yoga tutorials/courses/sessions and for each course video, upon payment of fee, that validity is for the period of one year (365 days). Post termination of one year subscription, in order to access the yoga tutorials/courses, you would be required to re-enrol the desired tutorials/courses/sessions for another term of viewership. The enrolment to Anliveda content does not support auto-renewal scheme. When you create an account with us, you guarantee that you are above the age of 14 and have the parental permissions, and, that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Website.
2. You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Website or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
3. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion. You can terminate your account by doing the following: by emailing us.
4. The enrolment charges for the Anliveda services and any other charges you may incur in connection with your use of the services, such as taxes and possible transaction fees, will be charged based on each yoga tutorial/course.
5. No payment is refundable on the event of non-usage of the content by the user.
6. This enrolment is non-transferrable.
7. The enrolement as user with an Anliveda account entitles you to use the Asana Library as well as the Meditation Audio Services free of charge.

Payment Methods & Purchases
1. For the purpose of the purchase of Anliveda content or any product available on the website, you shall be redirected to a third party payment gateway whose services has been hired by Anliveda in order to support Domestic and International Credit and Debit Cards, Net banking and UPI. To effectuate a purchase, you will be asked to supply your credit card number, expiration date, CCV, billing address, and shipping address.
2. All payments shall be processed immediately through a third party service. We are not responsible for the retention or safety of your billing information that is collected by the third party service.
3. You hereby represent and warrant that: (i) you have the legal right to use any payment method(s) in connection with any purchase; and that (ii) the information you supply to us is true, correct and complete.
4. We reserve the right to refuse or cancel your order at any time for reasons including, but not limited to: product or service availability, error(s) in your order, or for any other reason.
5. We at Anliveda do not save any banking details on our database. Hence, you would be required to re-type your banking details for the purpose of finishing every fresh transaction.
6. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Local tax charges may vary depending on the Payment Method used.
7. In an event where the payment is not successfully transferred to Anliveda and yet the amount is debited from your bank account, it is the responsibility of the gateway provider that the amount will be refunded within the next 7 to 10 business days (depending upon the nature of the transaction).
8. We have the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected. If fraud or an unauthorized or illegal transaction is suspected, we have the right to contact law enforcement to report the above actions and to provide your information.
9. Refund: We do not offer refunds on purchases made on this web-site.

Passwords and Account Access
1. The passwords are saved only in an encrypted format on Anliveda servers in order to maintain privacy of the subscriber and are not accessible by any third party. The subscribershall be responsible for any activity (including but not restricted to subscription(s) and purchases) that occurs through itsAnliveda account. To maintain control over the account and to prevent anyone from accessing the account (which would include information on viewing history for the account), the subscriber should not reveal the password or login credentials associated with the account to
  anyone. You are responsible for updating and maintaining the accuracy of the information you provide to us relating to your account and user profile. We can suspend your account in order to protect your subscriptions becoming victim of identity theft or other fraudulent activity upon your request.

Copyright and Trademark Policy
1. Anliveda respects your privacy and expect our users to do the same when using the Services. We have adopted and implemented the Anliveda Copyright and Trademark Policy in accordance with applicable law.

Web-site, MVY Calendar features, mobile phone application and all content and other materials on this web-site, including, without limitation, all logos, designs, text, graphics, pictures, information, data, software, sound files, other files and the selection and the arrangement thereof (collectively, “Content”) are the proprietary property of Anliveda Yoga Organics Pvt. Ltd. and are registered trademarks.
3. The yoga course videos self-produced from external yoga teachers presenting their course videos under the Terms agreed on Anliveda web-site and participating as per agreement on the Anliveda web-site belong to them as their products and fall under their responsibilities.
4. We respect the intellctual property rights. If you believe in good faith that materials hosted by us infringe your copyright, you (or your agent) may send us a written notice that includes the following information. Please note that we will not process your complaint if it is not properly filled out or is incomplete. To report that your intellectual property rights have been infringed upon, please contact: info@anlivedayoga.com with the following: 1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright’s interest, 2. A description of the copyrighted work that you claim has been infringed, including URL (i.e. web page address) of the location where the copyrighted work exists or a copy of the copyrighted work, 3. Your address, telephone number and e-mail address, 4. a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, agend or the law. Please note that we will not process your complaint if it is not properly filled out or is incomplete.
5. We are not responsible for content on web-sites operated by parties other than us.

Warranties and Limitations on Liability
1. The Anliveda service is provided “as is” and without warranty or condition. In particular, our service may not be uninterrupted or error-free. You waive all special, indirect and consequential damages against us. We hereby disclaim all warranties and conditions with regard to this information, products and services, including all implied warranties and conditions of merchantability, fitness for a particular response, title and non-infringement.
2. We assume no liability for availability, errors, or inaccuracies in the information provided on this Website. We may experience delays in updating information on the Website and in our advertising on other websites. The information, products, and services found on the Website may contain errors or inaccuracies or may not be complete or current. Services may be incorrectly priced, described inaccurately, or unavailable on the Website, and we cannot guarantee the accuracy or completeness of any information found on the Website. We expressly reserve the right to correct any pricing errors on our Website

Governing Law and Jurisdiction
